Michelle Dawson
Providing workplace-related legal services to clients in various sectors for around 20 years, Michelle has built her reputation and practice by applying her specialist technical skills and real-life business knowledge to assist her clients toward successful outcomes, whilst still managing risk and applying commercial good-sense.
Michelle’s work as an advisor and advocate spans all aspects of human resources, employment, industrial and anti-discrimination law, in particular in:
- Providing HR advice and assistance, including as to employee grievances and complaints, disciplinary action, disciplinary process and termination issues
- Employment disputes, litigation and dispute resolution, including dismissal, general protections, breach of contract claims
- Post-employment confidential information and restraint-related disputes and litigation
- Drafting, negotiating, interpreting and advising on employment contracts and contractor/consultancy agreements
- Contractor arrangements and agreements
- Workforce management strategies, including stand down, redundancy, outsourcing and restructure
- Enterprise bargaining, industrial strategy and disputes
- Legislative and Enterprise Agreement/Award interpretation, compliance and defence of prosecutions
- Equal Opportunity/Discrimination/Sexual harassment/Harassment/Bullying risk management, investigations and dispute resolution
- Transfer of business on sales, mergers and acquisitions, including legal due diligence and the preparation of employment-related terms and conditions
- Interpreting employment legislation including the Fair Work Act 2009 (Cth)
- Workplace investigations
- Drafting, interpreting and advising on workplace policies and procedures
- Devising and delivering workplace training
- Auditing employment and industrial process, practice and procedure to assist the implementation and maintenance of appropriate and compliant approaches
Accredited by the Law Institute of Victoria (LIV) as an accredited specialist in workplace relations in 2012, Michelle is also a longstanding contributing member of the LIV Accredited Specialisation Scheme Workplace Relations Advisory Committee and a member of the NSW Law Society’s Employment Law Committee. Michelle is also a member of the Australian Human Resources Institute and the Industrial Relations Society of NSW. Michelle founded and established Emplawyer in 2022.
